Fiscal Representation for VAT issues:
The European VAT-system is rather complicated.
As a result of the removal of fiscal borders within the European Union(EU) per 1 January 1993, foreign entrepreneurs more often get into touch with the Dutch and Belgium VAT. The term “foreign entrepreneurs” is understood to mean entrepreneurs who are not domiciled or resident in the Netherlands or Belgium and have no permanent establishment either.
In the Netherlands and Belgium it is possible for a foreign entrepreneur to have himself represented by a tax representative. He acts on behalf of the foreign entrepreneur as regards the declaration and payment of (Dutch or Belgium) VAT and other administrative obligations, such as the so-called listing and declaration for the Central Bureau of Statistics.
Value Added Tax for import
In the Netherlands and Belgium it is possible to shift payment of VAT which is due in case of import to the periodic domestic declaration of the Dutch importer, who has obtained a licence to do so. By appointing a tax representative a foreign entrepreneur can also avail himself of this possibility in the Netherlands and Belgium.
The procedure is as follows: on behalf of the foreign entrepreneur the tax representative performs the periodic domestic declaration of VAT, in which the VAT due upon import is stated. In the same declaration, however, this VAT due is deducted again. Thus nothing is paid on balance. In the normal import declaration VAT must be paid back simultaneously with the import. Only later can this be claimed back from the Tax Department.
The possibility of applying this arrangement entails a major liquidity and financial advantage for the foreign entrepreneur.

Train & truck loading
The new facility will further RK-oil ambition to cover all modes of transport and is a response to growing customer demand for rail transport.
It will be used initially to load and unload block trains with biodiesel to and from Germany, Austria and Italy. Driven by growing customer demand for rail transport, throughput is expected to rise quickly, from around two trains a week at the start to one train a day.
Future
The facility can also be modified in future to handle other oil products such as aviation fuels, gasoline, diesel and edible oils. In the medium term, throughput could increase to two trains a day.
Ship/ship discharge
Starting in March 2010 the sea jetty falls under the Petroleum regime. At our 420 meter long sea jetty, two sea going ships, of up to 100,000 ton DWT, can be processed simultaneously, 24 hours a day, 7 days a week. A 300 meter long and 70 meter wide area will fall under the petroleum regime.
We offer the jetty for ship to ship discharge for the following products:

Mineral Products classes 1, 2, 3 and 4

Liquids who belong to the ADNR classes 3, 6.1, 8 and 9

Not under ADNR classified liquids
The discharge needs to be done using certified hoses that are suitable for the products that are being discharged. The ship/agent will be responsible for supplying the hoses and for the connecting and disconnecting of the hoses.

VESSEL OWNERS LIMITED LIABILITY
The Hague Rules and COGSA (Carriage of Goods by Sea Act) was developed to protect vessel owners against legal liability to shippers for circumstances out of owners control. COGSA limits vessel owners liabilities to USD 500 per shipping unit. It also relieves all their liability to shippers in 17 situations known as the Hague/COGSA Defenses. This means shippers have no legal recourse against vessel owners when their goods are lost or damaged by these 17 causes.
ALL RISKS INSURANCE VS. DECLARED VALUE
All Risks insurance protects the shipper against physical loss or damage to their cargo from external causes, subject to policy terms and conditions. It is not necessary to prove the carriers liability.
